An NRI can authorise someone in Hyderabad to manage, rent or sell property through a Power of Attorney signed abroad. It must be notarised and apostilled, or attested at an Indian mission, then stamped in Telangana within three months of reaching India and, for property dealings, registered at the Sub Registrar Office.
What a Power of Attorney does, and what it does not
A Power of Attorney (PoA) is a written authority that lets another person, called the attorney or agent, act in your name. For NRI owners of Hyderabad property it is the single document that makes remote ownership workable: your attorney can sign a rental agreement, pay municipal tax, apply for an electricity name change, attend the Sub Registrar Office, or execute a sale deed.
What a PoA does not do is transfer ownership. The Supreme Court made this clear in Suraj Lamp and Industries v State of Haryana (2011): a General Power of Attorney, even one combined with an agreement of sale and a will, does not convey title. Title passes only through a registered conveyance such as a sale deed. Your attorney may sign that sale deed on your behalf, but the PoA itself is never a substitute for it.

Special or General: which one should you sign?
For a sale, a Special Power of Attorney is almost always the better choice. It names the property precisely (survey number, flat number, extent, boundaries and the parent document number), names the acts permitted, and ends when the job is done. Buyers, banks and Sub Registrars are more comfortable with it, and your exposure is limited to that one transaction.
A General Power of Attorney makes sense only when you need continuing management of several assets and you trust the attorney completely, typically a parent, spouse or sibling. Even then, you can narrow a GPA with limits: no sale without your separate written consent, no power to mortgage, no power to appoint a substitute, and a fixed validity period.
How to execute the PoA outside India
A PoA signed abroad must be authenticated before an Indian Sub Registrar will act on it. There are two routes, and which one you use depends on the country you live in.
- Get the draft right first. Have the PoA drafted for Telangana practice, on plain paper, with the property schedule, your passport or OCI details, the attorney's Aadhaar and PAN, and two witnesses.
- Route A, Apostille. If your country is a party to the Hague Apostille Convention, sign before a local notary with witnesses, then obtain an apostille from the designated authority of that country. Check the current list of member countries on the HCCH Apostille Section.
- Route B, Indian mission attestation. If your country is not a Convention party, or you prefer this route, book an appointment at the Indian Embassy or Consulate and sign in front of the consular officer, who attests the document.
- Courier the original to India and keep the courier receipt. The date the document first reaches India starts a legal clock, explained below.
- Stamp and adjudicate in Telangana within three months, then register the PoA at the Sub Registrar Office if it deals with immovable property.
Common mistake: signing before a foreign notary and couriering the document without an apostille or mission attestation. Sub Registrars routinely return such PoAs, and you lose weeks re-executing the document.
The three month stamping rule you cannot miss
Section 18 of the Indian Stamp Act, 1899 requires an instrument executed outside India to be stamped within three months after it is first received in India. In practice, your attorney presents the original to the District Registrar acting as Collector of Stamps, pays the duty assessed, and receives an adjudication endorsement.
Missing the window is expensive rather than fatal. In a 2022 case, the Andhra Pradesh High Court held that a GPA presented late can be impounded and validated on payment of the duty and a penalty, instead of simply being rejected. Telangana follows the same central Act, so plan on the three month window and avoid the penalty route entirely.
Stamp duty on a PoA in Telangana depends on the type of authority and the relationship between you and the attorney. A PoA that authorises sale to a person outside the family can attract a much higher duty than a family management PoA. Confirm the current rate for your specific wording with the Sub Registrar or on the IGRS Telangana portal before your attorney visits.
Registering the PoA at the Sub Registrar Office
Section 33 of the Registration Act, 1908 recognises a PoA executed abroad for presenting documents for registration when it is authenticated by a notary public or an Indian consular officer. For any PoA that touches immovable property in Hyderabad, registration is the safe default. A registered PoA appears in the Sub Registrar's records, so a buyer's lawyer can verify it, and it is far harder for anyone to dispute later.
Your attorney attends the Sub Registrar Office with the stamped original, their own Aadhaar and PAN, photographs, and copies of your passport or OCI card. Telangana offices capture biometrics and photographs at registration. Book the slot through the IGRS portal to avoid a wasted visit.
Clauses that protect you from misuse
Most PoA disputes we see come from vague drafting, not from bad attorneys. These clauses close the common gaps:
- Exact property schedule matching the registered title deed, including boundaries and extent.
- Named acts only, for example "to execute and present for registration a sale deed for the Schedule property".
- Payment instruction: sale consideration must be paid only by banking channel into your NRO account, never to the attorney personally.
- No substitution: the attorney cannot appoint another person.
- Validity period with an automatic end date.
- Reporting duty: copies of every document signed must be emailed to you within a set number of days.

How a PoA ends, and how to revoke one safely
Under the Indian Contract Act, 1872, an agency ends on revocation by you, on completion of the business, on expiry of any stated period, or on your death. That last point matters for families: an attorney cannot keep acting after the principal has died, and any sale signed after death is open to challenge by the heirs.
To revoke, execute a revocation deed, register it at the same Sub Registrar Office where the PoA was registered, and send written notice to the attorney, your bank, the apartment association and any tenant. Registration of the revocation is what protects you against a third party who later claims they relied on the old PoA.

Frequently asked questions
Can I sign a Power of Attorney at a notary abroad without an apostille?
For use in India, a foreign notarisation normally needs an apostille if your country is a Hague Apostille Convention member, or attestation at an Indian Embassy or Consulate if it is not. Sub Registrars in Telangana routinely return PoAs that carry only a foreign notary seal.
How long do I have to stamp a PoA after it reaches India?
Three months from the date it is first received in India, under Section 18 of the Indian Stamp Act, 1899. Keep the courier receipt as proof of the arrival date. A late PoA can usually be validated only after paying duty and a penalty.
Can my attorney sell my Hyderabad flat using a GPA?
